We paid a 1st and last months rent when we moved in. We paid for December's rent and then gave notice on Dec. 14 that we would be moving out and our last day in the apt would be Dec. 31. There was not a lease because it was month to month. I asked him to come down a do a walk thru and he told me to just leave the keys on the counter. He send me a check for $225 of $900 for our last months rent. He writes a note on a post it saying this was fair on many factors and if we have a problem to call him. There were no damages to that apartment and I had the neighbor downstairs do walk thru with me when he wouldn't as a witness to the condition of the aprtment. The aprtment was cleaner that when we left than when we moved in. Our rent was paid on time every month and never had a problem with us. We even took pitures of the aprtment and lited it on Craigslist for him. I am send a certified letter asking for the itemed charges that equal $675. I will take him to small claims court if I have to. I took some pictures before I left as well.
If I object to landlord's security deposit claim in florida, do they have a timetable they have to respond by?
When I moved out of my apartment I was expecting a partial return on my security deposit based on the conversations with the landlord. Now he has come up with a bunch of charges that he never mentioned and sent me a letter to withhold my deposit and stating I owed a bill and must respond within 15 days pursuant to Florida statues. I sent a certified letter explaining why I object in October but have not received any notice back. I called to ask what the holdup was and they said they just haven't gotten to it. If I have 15 days to object to their claim to withhold deposit, is there any statue that says the landlord has to respond to the objection within any timeframe or forfeit the right to the deposit?
