Question: Would filing bank ruptcy in c.a. san luis obispo county erase debt for hitting a telephone pole? (Posted by: on 2010-08-24 21:03:08) My boyfriend ran into a telephone pole here in San Luis Obispo County in California, PG &E is billing us over 4 thousand dollars and AT &T is also billing 4 thousand dollars, we are unable to afford this debt, is filing bank ruptcy going to erase this debt? If so, is filing bank rupty the only answer??? |

Posted by: Carlotta on 2010-08-24, 21:04:01 No, bankruptcy will not remove his legal responsibility to replace or repair damage he caused. Sorry people, it DOES NOT work like that. He's going to have to pay those fines because bankruptcy only covers personal debt. Not debt you owe due to a crime. |

Posted by: bdancer222 on 2010-08-24, 21:09:50 The debts probably could be discharged in bankruptcy, but if these are his only two debts, $8 is an awfully small amount to resort to bankruptcy. It will also cost about $1K or $2K in legal fees to file. Bankruptcy will stay on his credit for 10 years. Maybe getting a second job to pay off the debt is a better idea. Also, he should have liability insurance to cover this damage if he hit the poles with a vehicle. |
